Terms of Service 

 

This document lists the Close Racing Limited Terms and Conditions for any service(s) that we may provide to you. By booking and paying for any service with Close Racing Limited you understand and agree to all of these listed terms which constitutes a legally binding and enforceable agreement between you and Close Racing Limited. These Terms and Conditions are reviewed and amended frequently and should be read in full prior to any agreement being made.

 

ARRIVE & DRIVE PACKAGES [TEST DAYS, TRACK DAYS, RACING EVENTS]

 

When you arrive, you should inspect the hire car. If there is any damage, other than minor surface damage (small scuff marks, small scratches) you must ensure it is recorded and that a senior member of the team are made aware. You will be responsible and liable for any damage to the hire vehicle which is not recorded at the start of your hire period. We will inspect the hire vehicle on its return for any damage or changes in condition from that which was described in the Vehicle Condition Report. If you are unable to or refuse to complete the inspection with us, we will inspect the vehicle in your absence and notify you of our findings. Some damage may not be apparent at the post-hire inspection, such as mechanical damage (for example but not limited to areas such as the engine, fuel tank or clutch) or damage hidden by adverse light or weather conditions. If we find such damage, we will notify you with evidence of the same.

 

Arrive & drive with hire car (test day(s), track day(s) or racing event(s) you are responsible for:

•       Settling the outstanding balance, prior to the start of the event

•       Paying any additional charges at the end of the vehicle hire period following our inspection of the vehicle hire, such as for the repair or replacement of panels, paintwork, mechanical or structural damage encountered whilst in your possession, or other expenses such as fuel.

•       Driving the hire vehicle in accordance within the rules and regulations of the appropriate circuit/racing event/championship.

•       Not driving the hire vehicle in such a way that would cause mechanical failure or fault.

•       Ensuring you have a valid driving licence and/or appropriate racing licence for the booked event.

•       Ensuring you have the appropriate membership for the race event and/or paid any required race entry fees/ circuit fee.

•       Ensuring that all of your protective equipment is in date and appropriate for the circuit/event such as approved racing boots, racing overalls, helmet, FHR device and any other attire that the circuit/event/championship regulations require. 

Failure to meet your responsibilities will not result in a refund from Close Racing Limited.

 

Close Racing Limited will be responsible for:

•       We provide you with exclusive use of a Mazda MX-5 MK1 race car created to the regulations of the BRSCC Mazda events during the time of the specific event (unless a previously agreed shared drive).

•       We provide you with fuel (up to 60 Ltrs) for track and test days along with the required amount to compete in championship racing events.

•       Ensuring the car is fully prepared and ready to race (spanner check, brake checked and mechanically sound).

•       Providing mechanical support service for the duration of the hire period, where reasonably possible to do so.

•       If there is an electrical or mechanical fault or failure whilst on hire to you, Close Racing Limited will take all reasonable steps to address and/or fix the issue where possible. If in the unlikely event that the hire vehicle is deemed not fit to run, you will not be entitled to a refund of any monies paid.

 

SUPPORT 

Where you have instructed Close Racing Limited to support you and your vehicle in a test day(s), track day(s) or racing event(s), you are responsible for:

•       Settling the outstanding balance, prior to the start of the event.

•       Not driving the vehicle in such a way that would cause mechanical failure or fault.

•       Ensure that your vehicle is sufficiently prepared prior to the race event.

•       Providing sufficient fuel for track/ test days/ racing events. If you require Close Racing Limited to provide the fuel for track/test days a further charge for fuel used will be issued after the event day. We hold the right to add an administration fee if we see fit.

•       Transporting your vehicle to and from the circuit.

•       Ensuring you have a valid driving licence and/or appropriate racing licence for the event.

•       Ensuring you have the appropriate membership for the race event and paid any race entry fees.

•       Ensuring that all of your protective equipment is in date and appropriate for the circuit/ racing event such as approved racing boots, racing overalls, helmet, FHR device and any other attire that the circuit/event/championship regulations require.

Failure to meet your responsibilities will not result in a refund from Close Racing Limited.

 

Close Racing Limited will be responsible for:

•       Providing mechanical support service for the duration of the support period, where reasonably possible.

•       Providing data analysis and support for the duration of the hire period, where reasonably possible.

•       Providing an expert setup on the car for the duration of the booking period, where reasonably possible.

•       In the unlikely event that the mechanical team are not able to get your vehicle back out at a racing event, or is deemed not fit to run you will not be entitled to a refund of any monies paid.

 

OTHER INFORMATION

Close Racing Limited will take all reasonable steps to ensure that any work or service provided is of a sound quality and good standard.

By appointing Close Racing Limited to undertake any work or provide any service for you, you understand that motorsport, mechanical work, racing and all other related activities may be dangerous and result in injury and/or death, and Close Racing Limited take no responsibility for this, should it occur.

By appointing Close Racing Limited to undertake a service for you, you agree that your full name, age, photographs and/or videos of you, your car number, and your car may be shared on social media platforms such as but not limited to Facebook, Instagram, YouTube etc. If you do not wish for this information to be shared, you must inform us in writing prior to us undertaking any work or services for you.

By appointing Close Racing Limited to undertake a service for you (such as workshop services, track day services or support, test day services or support, corporate day services or support, racing services or support), you understand that you are responsible for ensuring that payment is made promptly upon receipt of invoice. If you have entered into a payment plan agreement with Close Racing Limited you are responsible for ensuring that those payments are made in full and on time. You are responsible for continuing to make those payments whether you choose to compete in the selected events or not. You are responsible for continuing to make those payments if a circuit, event organiser, Championship organiser, Motorsport UK or Government body cancels an event or multiple events. Failure to do so may result in legal action being taken. 

No one other than the hirer (driver or Guardian of said driver if under 18 years old) are privy to our agreement and terms and conditions and permitted assignees shall have any right to enforce any of its terms. Any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims), shall be governed by, and construed in accordance with the law of England and Wales.

Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this agreement or its subject matter or formation (including non- contractual disputes or claims).
